Income Tax School. Students who purchase any courses through third
party schools or other organizations must address all refund issues with
the entity through which they made that purchase.

The term for courses over 30 hours is 6 months from date of registration. The term for courses up to 30 hours is 4 months from date of registration. The term for CPE seminars of 6 hours or less is 1 month from the date of registration. Students will receive training in the subjects outlined in the promotional literature. Completion of the course does not guarantee employment, nor are graduates required to work for the Company.
If for any reason the student is not satisfied, he/she may withdraw during the first quarter of the term and receive 75% tuition reimbursement; students withdrawing during the second quarter of the term will receive 50% tuition reimbursement; students withdrawing during the third quarter of the term will receive 25% tuition reimbursement; and students withdrawing during the final quarter are not eligible for a refund. A nonrefundable registration fee of $100 applies to all Self-Study and online courses. Book and material fees are nonrefundable.
Students may cancel enrollment within three (3) business days (weekends and holidays excluded) without financial obligation (100% tuition reimbursement) other than the nonrefundable fees described above. Students wishing to withdraw/cancel after the three (3) day period may do so by written notice, in which case the terms above will apply. Students who do not finish the course within the allotted time frame must pay a $65

Oregon Self-Study and Online for Individual StudentsProgram Information: This course is an 80-Hour Basic Income Tax Course. This Distance Education course is delivered through an online platform. Upon registration and payment of tuition and fees, each student will receive a unique User Identification Number and Password. Books will be shipped to the student at no additional charge. Classes begin upon registration and payment of tuition and fees. Registrations are accepted year-round. The course is 80-hours in length and is expected to be completed within a 4-month period.
Terms of Contract: The effective date of this contract is the date of enrollment. The total cost of the course is $549 (Registration Fee: $49 and Tuition: $500). There are no additional fees for books and materials. Full payment of tuition and fees is expected at the time of enrollment. The school accepts payments in the form of a money order, cashier’s check or credit card.

581-045-0027- A student may cancel enrollment by giving written notice to the school within 5 business days after the date of enrollment or prior to delivery to the student of any lesson materials, whichever occurs later. If cancellation occurs during that five-day period, all monies paid to the school by the student shall be refunded.
- When an enrollment application has been accepted by the school and not canceled under the provisions of section (1) of this rule, the following schedules of maximum charges may be assessed by the school:
- If termination occurs in the period between the delivery of lesson materials and receipt by the school of the first completed lesson materials, the school may charge an amount equal to 15 percent of the total tuition cost, or $150, whichever is less; that being established as its registration fee;
- If termination occurs after receipt by the school of the first completed lesson materials and up to 50 percent of the completed lesson assignments, the student shall be entitled to a pro rata refund of the total tuition cost of the distance learning portion of the program. The school may retain the established registration fee;
- If termination occurs after receipt by the school of 50 percent or more of the completed lesson assignments, the school may retain 100 percent of the total tuition costs plus the established registration fee; and
- Calculation of the pro rata refund under subsections (2)(a)-(c) of this rule is determined by dividing the total number of lessons comprising the period of enrollment for which the student has been charged into the total number of such lessons not submitted by the student.

- That tuition charges will accrue based on the hours that the program is offered (3-hours per Federal chapter and 1-hour per State chapter) by the school and that I have contracted/scheduled to complete, rather than my actual attendance;
- That any refund calculation is based on the total number of completed chapters;
- Students are required to complete no less than 3 chapters (a combination of 2 Federal and 1 State chapter or 1 Federal and 2 State chapters) per week. The expected completion time for this course, including completion of exams, is 16-weeks or 4-months.
- Students who fail to complete a minimum of 3 chapters per week will be contacted by an instructor to determine the cause of the delay in completing assignments.
- It is expected that all students will complete this course within a 4-month period. However, the school will allow students as long as 6-months from the date of enrollment to complete the course. This extra time is allotted in case of extenuating circumstances or issues which may cause the student an unexpected delay in completing the course.
- At the end of the 6-month period (also known as the “course termination date”) the student’s User Identification Number and Password will be deactivated. If the student wishes to complete the course, he/she will be required to request a reinstatement in writing via email, addressed to schooladmin@peoplestax.com. The student will be required to pay the registration fee ($49); however, the tuition ($500) will be waived. A student may request a reinstatement only once.

Tax Practice Management Manuals are non-refundable.
Tax Practice Management Materials License AgreementIMPORTANT: The Income Tax School and/or Tax Practice Management Materials ("Materials") which are the subject of this Agreement are proprietary products of Peoples Income Tax, Inc. ("PEOPLES"). They are licensed, not sold, and are licensed to you only on the condition that you agree to and comply with this INCOME TAX SCHOOL & TAX PRACTICE MATERIALS LICENSE AGREEMENT ("Agreement").

In consideration of and upon receipt of payment of the annual License Fee in the amount specified on the Order Form attached hereto/on the reverse hereof and incorporated herein by reference and subject to the following terms and conditions, PEOPLES grants to you a one year renewable non-exclusive, nontransferable, non-assignable license to use at the location (if any) set forth on the Order Form, the Materials indicated on the Order Form. You are licensed to use the Materials solely for the purpose of operating a tax preparation training program in a classroom and/or home study correspondence course in the case of the Income Tax School materials and/or as tools for managing your business in the case of the Tax Practice Management materials (collectively, the "Programs"). The Materials licensed hereunder do not include enhancements or updates. Such enhancements and updates must be licensed separately from PEOPLES. Included with payment of the annual License Fee is telephone support as described at PEOPLES' Web sites at www.peoplestax.com and www.theincometaxschool.com for use by you in conducting the Programs (as herein defined). You agree to use reasonable efforts to protect the Materials from unauthorized use, reproduction, distribution, or publication.
2. PEOPLES retains exclusive ownership of the Materials licensed under this Agreement. You acknowledge that the Materials are owned by PEOPLES and are protected by United States copyright laws and applicable international treaties and/or conventions. You have not been granted any trademark license as part of this Agreement and may not use or trade under the name or marks, which you acknowledge are owned by PEOPLES, "The Income Tax School", "Peoples Income Tax" and "RefundMax", except as set forth in this Agreement. You may not remove or obscure any copyright or trademark notices on or in the Materials. The Materials shall not become subject to application for patent or copyright by you. Except in the ordinary course of conducting the Programs, you shall not provide or disclose or otherwise make available the Materials or any portion thereof in any form to any third party. All of your employees having access to the Materials will be bound by confidentiality and non-competition agreements obligating them to the same extent you are obligated hereunder. You will not copy or reproduce any of the Materials by any means, except for forms, documents and advertisements intended to be duplicated in the ordinary course of conducting or implementing the Programs. Should you copy any of the Materials in violation of this Agreement, you agree to pay PEOPLES a fee of three times the then current purchase price of each unauthorized copy which amount the parties agree is a good faith estimate of the damages PEOPLES will incur as a result of your unauthorized copying.
3. During the term of this Agreement, neither you nor any of your employees or affiliates shall, directly or indirectly, compete with PEOPLES in the business of operating any Program or providing materials intended for use in any Program in any area in which PEOPLES operates, nor will you or any of your employees or affiliates attempt to hire any employee of PEOPLES, encourage any employee to terminate his or her relationship with PEOPLES, solicit or encourage any customer of PEOPLES to terminate its relationship with PEOPLES or to conduct with any other person or entity any business or activity which such customer conducts with PEOPLES.
4. The Effective Date of this Agreement shall be the earlier of when you either sign the Order Form attached hereto/on the reverse hereof or sign this Agreement. The initial term shall expire on April 30 of the year next following the year in which the Effective Date falls. Unless earlier terminated in accordance with the terms hereof, this Agreement shall automatically renew for additional terms of twelve (12) months upon expiration on the then current term subject to payment of the then current annual renewal fee as set forth on PEOPLES' Web sites at www.peoplestax.com and www.theincometaxschool.com prior to renewal. This Agreement shall terminate at the end of the then current term in the event either of the parties notifies the other of non-renewal at least forty (45) days prior to the end of the then current term. PEOPLES may terminate this Agreement at any time in the event you breach any of the terms hereof. Except as set forth in Section 5, within ten (10) days of termination of this Agreement, you shall return to PEOPLES all Materials in your possession or destroy such Materials and furnish PEOPLES with a sworn declaration confirming such destruction. The provisions of Sections 2, 4, 6 and 7 shall survive termination of this Agreement.

Subject to the terms and required return data and certifications more particularly described at PEOPLES Web sites at www.peoplestax.com and www.theincometaxschool.com regarding its MONEY BACK GUARANTEE, within fifteen (15) days of receipt of The Income Tax School Materials, you may elect to terminate this Agreement and return the The Income Tax School Materials to PEOPLES for a refund of the license fee less shipping and handling charges provided the The Income Tax School Materials are in re-sellable condition, in PEOPLES' sole discretion. Tax Practice Management Materials may not be returned for a refund.
6. YOU ACKNOWLEDGE THAT INCOME TAX PREPARATION RULES, REGULATIONS AND METHODS ARE SUBJECT TO CHANGE AND ARE OF SUCH COMPLEXITY THAT THE MATERIALS MAY BE INACCURATE, INCOMPLETE OR CONTAIN DEFECTS. THE MATERIALS ARE PROVIDED "AS-IS" WITHOUT WARRANTY OF ANY KIND INCLUDING ANY WARRANTIES OF MERCHANTABILITY, FITNESS FOR A PARTICULAR PURPOSE, TITLE, QUIET ENJOYMENT, ACCURACY AND NONINFRINGEMENT. PEOPLES SHALL HAVE NO LIABILITY OR RESPONSIBILITY FOR DAMAGES OF ANY KIND, HOWEVER CAUSED AND BASED ON ANY THEORY OF LIABILITY, INCLUDING SPECIAL, INDIRECT, PUNITIVE OR CONSEQUENTIAL DAMAGES ARISING OUT OF OR RESULTING FROM ANY PROGRAMS, SERVICES OR MATERIALS LICENSED OR MADE AVAILABLE HEREUNDER OR YOUR USE OR MODIFICATION THEREOF. THIS LIMITATION SHALL APPLY EVEN IF PEOPLES HAS BEEN NOTIFIED OF THE POSSIBILITY OF SUCH DAMAGES. IN NO EVENT MAY ANY ACTION BE BROUGHT AGAINST PEOPLES ARISING OUT OF THIS AGREEMENT MORE THAN ONE (1) YEAR AFTER THE CLAIM OR CAUSE OF ACTION ARISES, DETERMINED WITHOUT REGARD TO WHEN YOU SHALL HAVE LEARNED OF THE DEFECT, INJURY OR LOSS. THE ENTIRE AND AGGREGATE LIABILITY OF PEOPLES AND YOUR EXCLUSIVE REMEDY SHALL BE, IN PEOPLES' SOLE DISCRETION, TO CORRECT ERRORS, OR TO REFUND THE ANNUAL LICENSE FEE PAID BY YOU FOR THE CURRENT TERM AND TERMINATE THIS AGREEMENT. PEOPLES' SHALL NOT IN ANY EVENT BE LIABLE FOR MORE THAN THE ANNUAL LICENSE FEE PAID BY YOU TO PEOPLES FOR THE CURRENT TERM (WHETHER SUCH LIABILITY ARISES FROM BREACH OF WARRANTY, BREACH OF THIS AGREEMENT OR OTHERWISE, AND WHETHER IN CONTRACT OR IN TORT, INCLUDING NEGLIGENCE AND STRICT LIABILITY).
7. You are an independent contractor and are not an agent or employee of PEOPLES and you have no authority whatsoever to bind PEOPLES by contract or otherwise. You are responsible for obtaining all licenses, permits and approvals required under applicable law to operate your business and the Programs. You may not assign this Agreement, by operation of law or otherwise, without the prior written consent of PEOPLES. The parties to this Agreement hereby submit to the jurisdiction of the Federal and state courts located in Richmond, Virginia, in any action or proceeding arising out of, or relating to, this Agreement; and the parties waive all objections based on venue or forum non conveniens with respect to such courts. The parties agree that all claims in respect to such action or proceeding may be heard and determined only in such courts and they agree not to commence any legal or equitable proceeding in any other court. The parties further agree that any arbitration or mediation arising out of, or relating to, this agreement shall take place in Richmond, Virginia. The validity, construction, and performance of this Agreement shall be governed by the laws of the Commonwealth of Virginia (excluding its principles of conflict of laws). This Agreement will not be governed by the United Nations Convention on Contracts for the International Sale of Goods, the application of which is expressly excluded. If any provision(s) of this Agreement shall be held to be invalid, illegal, or unenforceable by a court or other tribunal of competent jurisdiction, the validity, legality and enforceability of the remaining provisions shall not in any way be affected or impaired thereby. No failure or delay by PEOPLES in enforcing any right or remedy under this Agreement shall be construed as a waiver of any future or other exercise of such right or remedy by PEOPLES. This Agreement constitutes the sole and entire agreement of the parties as to the matter set forth herein and supersedes any previous agreements, understandings, and arrangements between the parties relating hereto. This Agreement may only be modified in writing and signed by an authorized officer of PEOPLES.
