Tax Preparer Non-compete Agreements

If you employ tax preparers it is essential to have an employment agreement that includes non-compete, confidentiality and non-solicitation provisions that are enforceable. A non-compete during the term of employment is usually enforceable. However, for a non-compete provision that continues after termination of employment to be enforceable it must be reasonable in terms of (1) time period, (2) geographic scope and (3) restriction of livelihood. There are other factors to consider and consulting a qualified local attorney is advisable.
